[Broadcasting and Telecommunications] Registration of Personal Location Information Service Provider

EJE LAW successfully completed the registration of a personal location information service provider on behalf of a foreign company operating a shared e-scooter business in Korea.


The Act on the Protection and Use of Location Information (hereinafter referred to as the “Location Information Act”) requires entities intending to engage in personal location information services to meet certain criteria and register with the Korea Communications Commission. Although the recent amendment to the Location Information Act—effective as of April this year—eased market entry regulations by replacing the prior licensing regime with a registration system, entry into the personal location information sector remains challenging. Registration applications are only accepted four times per year, and applicants must still satisfy strict registration requirements. Among the required documents, the business plan is the principal basis for the registration review and evaluation. It must include information on the applicant entity, an overview of the business, physical infrastructure, and the administrative and technical measures for protecting location information. To earn the trust of the evaluation committee with respect to the long-term viability, scalability, and data protection integrity of the proposed business, the plan must be drafted in a systematic, detailed, and comprehensive manner.


Regulations concerning location information are not widely known, and it is not uncommon for businesses to inadvertently operate without proper compliance. The recent matter handled by EJE LAW is a representative example: the client was faced with the challenge of preparing a registration application within a limited timeframe of just three months before the next scheduled submission period. Drawing on its extensive experience and expertise accumulated through handling numerous personal location information service license applications under the prior licensing regime, EJE LAW provided thorough guidance on pre-application preparations and delivered detailed instructions on drafting the business plan.
